When I create a set from the cone hits it works. It doesn't matter if I use datums or not, the behavior stays the same.
Unfortunately I can't share this program. But see attached pictues:

3 - surface profile of the cone with UZ modifier -> doesn't work
4 - surface profile of the set -> works
5 - surface profile of the cone with UZ modifier -> works
